Welcome to Newsrift. These Terms and Conditions ("Terms") govern your access to and use of the Newsrift website, mobile applications, and all associated content, services, and functionalities (collectively, the "Service"). By accessing or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Newsrift. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms regularly.
User Accounts and Registration
To access certain features of the Service, such as commenting or premium content, you may be required to register for an account. When creating an account, you agree to:

- Maintain the security of your password and identification.

You must be at least 16 years old to create an account. If you are under 16, you may use the Service only with the involvement of a parent or guardian.
Content and Intellectual Property
1. Newsrift Content
All content provided on the Service, including but not limited to text, graphics, images, audio, video, software, and the compilation thereof, is the property of Newsrift or its content suppliers and protected by copyright, trademark, and other intellectual property laws. You may access and view the content for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, transmission, republication, display, or performance, without the prior written permission of Newsrift, is strictly prohibited. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Service.
2. User-Generated Content
The Service may allow you to submit, post, or display content, such as comments, reviews, or other materials ("User Content"). By submitting User Content, you grant Newsrift a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or control all rights to the User Content that you post and that the User Content is accurate and does not violate these Terms or any applicable law. Newsrift is not responsible for any User Content and reserves the right to remove or modify User Content at its sole discretion. You agree not to post any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
- Engaging in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
- Attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Uploading, posting, or transmitting any content that contains viruses, corrupted data, or any other harmful, disruptive, or destructive files or code.
- Collecting or harvesting any personally identifiable information from the Service without explicit consent.
- Using the Service to send unsolicited promotional materials or spam.
- Engaging in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Circumventing, disabling, or otherwise interfering with security-related features of the Service or features that prevent or restrict use or copying of any content or enforce limitations on use of the Service.
- Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Service, use of the Service, or access to the Service without express written permission by Newsrift.
Violation of any of these prohibitions may result in immediate termination of your access to the Service and may subject you to legal penalties. Newsrift reserves the right to investigate and prosecute violations of any of the above to the fullest extent of the law.
Subscriptions and Payments
Newsrift may offer premium subscription services ("RiftPro") that provide enhanced access and features. By subscribing to RiftPro, you agree to the following terms:
- Billing: You will be billed on a recurring basis (e.g., monthly or annually) as per your chosen subscription plan. Payments are processed through secure third-party payment processors. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
- Automatic Renewal: Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew, and you authorize us to charge your payment method for the renewal term.
- Cancellations and Refunds: You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing cycle. Refunds are generally not provided for partial subscription periods, except where required by applicable law. Please refer to our FAQ or contact customer support for specific refund policies.
- Price Changes: Newsrift reserves the right to change the prices for subscriptions at any time. We will provide you with reasonable prior notice of any price changes. If you do not agree with the new prices, you may cancel your subscription before the price change takes effect.
All payments are subject to the terms and conditions of our third-party payment processors. Newsrift is not responsible for any errors or issues arising from their services.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NEWSRIFT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEWSRIFT MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEWSRIFT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF NEWSRIFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT SHALL NEWSRIFT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE.
Indemnification
You agree to indemnify, defend, and hold harmless Newsrift, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms or your use of the Service. This includes, but is not limited to, any claims arising from your User Content, your use of the Service in violation of any law, or your breach of any representation or warranty made by you herein. Newsrift reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Newsrift in asserting any available defenses.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in New York, New York, for the purpose of litigating all such claims or disputes. Any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.
Severability
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by Newsrift on the Service, constitute the entire agreement between you and Newsrift concerning the Service.
